Employment Attorneys - Separation Agreements
in Denver and Aurora, Colorado
What is a separation from employment agreement?
They're written contracts that an employer gives an employee when that employee is laid off, fired, or otherwise terminated from employment. They are and may not be carefully analyzed by employees - sometimes they're just one of many papers an employee signs when leaving an organization.
Separation agreements vary, but they're usually related to severance pay, require a release of all claims and rights of the employee to seek recourse for the separation, and sometimes contain trade secret or non-competition provisions which can restrict or limit an employees ability to obtain subsequent employment. To encourage you to sign a separation agreement, an employer usually offers a better overall severance package. Many times employees simply sign the agreement without giving it much thought.
Have an employee attorney look at it
It's often a better idea to have an employment attorney take a look at the contract first. Separation agreements can include items that you may not want or which you should seek to modify or change. You may also want to seek other changes to the agreement, such as a favorable reference, outplacement services, additional compensation or extended benefits, non disparagement provisions, or other terms or conditions depending upon your circumstances and needs.
