Birth injury Cerebral palsy is a collection of disorders characterized by loss of movement and loss of nerve function. They can be the result of injuries to the brain during fetal development or infancy.

There's no system in place in the U.S., which we are aware of to precisely monitor the occurrence of cerebral palsy, but it has been estimated that about 2 of every 1,000 babies born have some variation of this disease.
A developmental disability
Since it affects the way children develop, it's considered a developmental disability. Babies born with cerebral palsy may or may not show symptoms at birth but as the nervous system matures, symptoms begin to show. The condition is not generally thought to be progressive, nor can it be cured, although with help, patients can often live productive lives.
Muscle tone
Regardless of the type of cerebral palsy, all children who have the disease have damage to the area of the brain, which controls muscle tone. Every case is individual, depending on the exact location and extent of the damage, but in general, the children often have either:
- Reduced muscle tone (limpness), or
- Increased muscle tone (rigidity)
- or a fluctuation between the two.
Types of cerebral palsy
Spastic cerebral palsy - the most common type, in which the child has jerky movements, stiffness, and difficulty holding or letting go of objects
Athetoid cerebral palsy - in which the child has trouble with coordinated movement, and makes involuntary movements, usually in the face and upper body. This type has poor muscle tone, causing trouble with walking and sitting.
Ataxic cerebral palsy - the rarest type, in which the child has poor balance and depth perception, and much shakiness which makes most daily activity difficult.
Mixed cerebral palsy - which is an individual combination of the above three types.
Cerebral palsy can be a birth injury
It can result from trauma during birth, and that trauma can be the result of negligence on the part of a medical professional. In order to prove negligence, you need a qualified birth injury attorney to investigate the circumstances.

Cerebral palsy is a life-long, debilitating condition. If it is the result of a doctor's negligence, you may be entitled to compensation. There can certainly be enormous expense in raising a child who has cerebral palsy. Perhaps you have a valid claim and could win a fair settlement.
